Here is what Lin Wood, the lawyer who’s advocating for Trump to overturn the election and steal the presidency for himself, was tweeting today:

That’s right folks, Wood is spinning a wild tale for how Trump is supposedly going to steal the election.  This wild tale contains several blatant falsehoods including:

  • The Vice President, who also serves as President of the Senate, controls the Electoral College procedures in the House and Senate.  This is blatantly false.  The Vice President’s role is largely ceremonial.  McConnell controls the Senate, Pelosi the House.  In order to challenge the Electoral College votes in the states, one Senator and one Representative are required to both object.  That objection then causes a debate and vote separately in the House and Senate.  Both houses must agree by simple majority or the objection fails and the original electoral votes stand.  The Vice President has NO ROLE in the House vote, and an objection will fail.  Period.
  • Wood is fantasizing that somehow, Pence is going to be jailed for somehow for treason, therefore forfeiting his Vice Presidency.  Then Pompeo would somehow ascend to that office and take control of the Electoral College process, which, as explained above, is not possible.
  • Wood then says that Pence will be shot, and Meadows, and McConnell will then be arrested for treason.
  • Lastly, the military will then side with Trump, take control of the Congress and the courts, awarding him the presidency.

In ordinary times, these would be the ravings of an unhinged madman, but in these times, there are millions of Americans who are actually following along on this lunacy and backing the notion that Trump can singlehandedly overthrow the US government and install himself as President dictator.

Fortunately for our democracy, this will never come to pass, but it’s terrifying we even have to consider its possibility.

  3. Lin Wood wants Pence to sing like a bird? I suppose if we’re under a military dictatorship it doesn’t matter what Pence might reveal about Trump. What’s behind close doors stays behind closed doors.

    Except for the public execution part. Probably Pay-Per-View so Trump can pay off the German bankers and Russian oligarchs.

    Okay, this stuff is just too bizarre. I wonder if he’s playing everyone for some reason we don’t understand. Either that or he’s on drugs. Anyone know what those might be? Hope he doesn’t drive a car. That could be deadly. Hard to believe someone could be this crazy without being committed to an insane asylum.

    A few additional details I seem to remember …

    * if Pence is arrested, there is a presumption of innocence. Any trial would take more than a few days. Pence would remain VP during and even AFTER trial, even after a conviction, unless he resigns OR there is a House resolution of impeachment and a Senate trial resulting in a 2/3rd majority.

    * when there is a vacancy in the Vice Presidency, there is NO automatic succession. A proposed Vice President needs to be confirmed by each chamber of our Congress. Chance of Gen. Flynn getting approval in EITHER chamber is remote.

    * If Pence is not President of the Senate on January 6, Iowa Republican Senator Chuck Grassley takes on the role as president pro tempore (with or without the dead pidgin from his farm yard). If he is unable or unwilling, OTHER members of the Senate majority, can be considered. “the Senate must choose a president pro tempore to act in the vice president’s absence. Unlike the vice president, the president pro tempore is an elected member of the Senate, able to speak or vote on any issue.”

    The only thing that makes sense to me is that Lin Wood and Sidney Powell are going to monetize this crazy somehow, with a target audience of people who think Alex Jones is left-of-center.

    If Lin Wood seriously thinks that Mike Pence could be indicted and jailed for treason, and that General Flynn could be confirmed by the Senate as the new vice president, all before the Electoral College votes are counted, I’d suggest a 72-hour psych evaluation.

    This idiocy needs to be stopped. Hopefully, these fools will be disbarred, and prosecuted for advocating the violeent overthrow of the US Government.

    Lin Wood. Is this some ploy aside from politics to secure “sympathy” for Kyle Rittenhouse? On appeal “my attorney was batsh!t crazy.” The ABA is more than a little remiss in multiple states for not swooping the more insane of the attorneys in Donnie’s orbit from the practice of law.

    Four years. Five counting the 2015/16 election season of outrage and insanity. Moscow Mitch is one temperature impervious terrapin. The crazy wing of the Republicon party adds flame under the pot daily, while Mitch does his daily backstroke seemingly oblivious. The guy is nearly as fireproof as he is crooked.

    Disbarment often comes up here in the Salon. I can understand that bar associations are reluctant to do that (remember the old joke of “why don’t sharks attack lawyers swimming in the ocean?”). And so many law degrees have been granted the past 30 years that there are many bottom feeders, willing to file any long-shot suit they can make money from.

    But can someone who knows more about this enlighten us? Clearly Trump’s lawyers have left reality behind and are filing frivolous suits that have no evidence and no chance of succeeding. Wood’s rants show an ignorance of constitutional law that I picked up in a required course in junior hight school. And I’ve had zero legal training since then.

    The most reliable path to disbarment is misappropriation of client funds. Everything else, almost, is arguable; and that’s the job of lawyers.

    Even if the lawyer is clearly insane, as long as he is not non compos the other lawyers are reluctant to sanction. The dividing line between being crazy and being overzealous is hard to discern.

    In addition, Woods’s tweets are the equivalent of saloon talk, not done in his capacity as an officer of the court. (Although I suppose a counterargument might be made.)

    It seems to me that Powell is much more obviously a candidate for bar sanctions.

    Professionals (except newspaper reporters who eat their own) are always reluctant to expel one of the club. I recall a brain surgeon in Iowa who kept operating on the wrong part. The other surgeons did nothing; it was the nurses who eventually got him disciplined.

    Woods and Powell are people who need to have people who care about their mental health (not their legal trade) to take a hand. Unfortunately, we are usually reluctant to interfere.

  21. RepubAnon @7: Yes this activity is monetized. It is intended to whip the Trumpers up into a frenzy so they will send more money to Trump’s SuperPAC to “save the election” but in fact will mostly go to his slush fund. Which he can then spend as he wishes.

    This will please Trump. Lin Wood wants to please Trump. It is that simple. The law doesn’t matter for that.

    Thanks, Harry Eagar, that clarifies a lot. My anecdotal evidence matches what you say about misuse of client funds being a primary cause for disbarment.

    So it’s sorta like tenure for a professor. As long as you don’t kill and eat the students (*), everything is ok.

    (*) Actually, as long as you don’t kill them until *after* they’ve paid their bursar’s bill.

    I feel this issue acutely. There was a man who worked in my newsroom who talked to his work intimates about killing his severely mentally deficient daughter rather than letting her live after her parents were gone.

    He did not say this to me; I worked a different shift and was not close to him, but I heard about it. I did nothing, justifying myself that he had not said it to me and it was just gossip no different from all the rumors about who in the newsroom was sleeping with whom.

    He shot his daughter, his wife and himself.

    Wood is embroiled in a lawsuit with his former partners, one of whom he assaulted in an elevator. This predates his association with the orange loser. Mentally unbalanced people seem to gravitate to trump.
