The Third Court of Appeals in Austin tossed out the charge against Rick Perry for “coercion of a public servant,” but left the felony charge of “abuse of official capacity” viable and standing.
It’s nitpicking. In actuality he abused his official capacity by coercing a public servant. The one they let stand is the stronger of the two charges.
Perry calls it a win but anydamntime you have the court affirming felony charges, you haven’t won.
FYI: There are nine justices on the Third Court. Seven of them were elected as Republicans, one was elected as a Democrat, and one was appointed by Governor Rick Perry. He can’t very well blame politics for this one. He will, but then I will giggle.

1Having seen a bit on Trump in Laredo last night on the news I’m still in a snit about the whole bunch, so I want Perry so deep in his own mess that he never gets out.
2Not enough to cause a grown man to giggle, … yet. pRick in prison stripes; those will be the good times with lots of guffaws. If we had true justice, every Klown in the Kar would be wearing prison stripes.
3Court website says there are six justices on the court.
“The Court is composed of a Chief Justice and five justices. It has intermediate appellate jurisdiction of both civil and criminal cases appealed from lower courts in twenty-four counties of Texas; in civil cases where judgment rendered exceeds $100, exclusive of costs, and other civil proceedings as provided by law; and in criminal cases except in post-conviction writs of habeas corpus and where the death penalty has been imposed.”

I’m seeing stories about Trump getting snippy at the lack of respect the GOP is giving him, and maybe running as a third-party candidate. Every time I read that, I re-enact the deli scene from “When Harry Met Sally,” complete with banging on my desk with my head back and yelling “YES! YES! YES!”

6One can only hope that former governor pRick will get some time to do. Sadly it will not be inside the Federal system but some time away for pRick would be helpful for all concerned.

8Yo, Stan. You’re right. I looked at the Third Court of CRIMINAL Appeals. That’s the wrong court. It is the Third Court of Appeals, with a chief justice and a five snappy justices. This is the Republican court that overturned Tom DeLay’s conviction. The Chief Justice and one justice were appointed by Rick Perry and haven’t faced election yet.

13This whole thing is becoming stranger. Perry’s attorney was on the news this evening telling everyone that the “bad”
14charge had been kicked out, leaving only “abuse of official capacity”, a” Class C Misdemeanor” , in place. He went on to say that Perry should be able to beat that in a heartbeat. Tonight Rachel Maddow went over that attorney’s statement and corrected him , explaining that the charge left in place, “abuse of official capacity”, is a felony with a possible prison time of 5 to 99 years. What on earth is his attorney trying to do?
So the court is stacked with Repugs. Not looking good for justice.
