Holy cow, Neil Gorsuch and John Roberts voted today to uphold Title VII of the Civil Rights Act.  They said someone cannot be fired from a job based on being “homosexual or transgender.”  And, damn, Gorsuch even wrote the majority opinion.

Now if we can just the Supremes to uphold the LGBTQ community’s right to health care, we’ll be doing some good.

  1. As an openly gay, married, committed practising Catholic, what is interesting to me is that Gorsucn is likewise a practising Catholic.

    Church teaching is in fact clear – “thou shalt not discriminate. All are welcome, equal”.

    Delighted to see that Gorsuch understands this core message of Catholic teaching.

    According to the commentary on the news after this happened, the talking heads were saying that this ruling DOES include healthcare and housing.

    So the recent shenanigans by HHS to cut gays from healthcare are now moot, as is the attempt by HUD to make it ok to ban trans people from homeless shelters.

    omg, is real change in the wind?
    To think that I may have lived to see it . . . .

    I am surprised–no, make that astounded–that both Roberts and Gorsuch joined the liberal justices in the majority, but I’m very happy about this ruling. May all other cases involving LGBT people be similarly resolved. Let equal rights be equal for all.

  7. With this being a 6-3 decision, it is an even more important one. It is also very welcome. As a gay man, I have always had to rely on the goodness of employers not fire me for being gay. Now, if only we can get affirmation that this also pertains to housing and healthcare, it would be much appreciated.

    Edit: A federal district court ruled against the administration, which the 9th U.S. Circuit Court of Appeals upheld last year, saying that “standing aside does not equate to standing in the way.”
    The administration appealed to the Supreme Court, but only two justices advocated to hear the case — conservatives Clarence Thomas and Samuel Alito. Thus, the lower court’s ruling remains in place.

    The equal protection provision of the application of Constitutional decisions will extend this decision into all areas of social and cultural public access, like service & seating in restaurants, as well as medical cover and access to public health services.

    Gorsuch is a pleasant surprise; Roberts isn’t. He is a strict Constitutionalist that acknowledges the impact of time and life on commerce and government. He will force government to govern, while Alito, step’n-fetchit & cave-in-awe refuse to submit to the discipline of law & policy.

    I was stunned, stunned I tell you, that Gorsuch voted with my tribe on this one. I have to laugh when conservatives whine that their religious freedom has been abridged. They didn’t worry about my religious freedom when they told me not to come back to the Catholic Church when I revealed, in confession, that I am a lesbian. So they can have their small god who doesn’t accept people like me. I’m sure the Great Spirit is gagging over their “outrage” because she never told them to discriminate, they used their gift of “free will” to do it all by their narrow-minded selves.

  15. Did some research on Gorsuch during his confirmation hearing. He does have in his past a similar result in another case. Can’t recall the name today. But its in the research. He found for a little guy suing something big. The little buy really was a victim. This one example gave me some hope that over the years he would turn out to be surprise that other previous justices were like Douglas.
