Yes, Judge Jerry Smith is From Texas

Judge Jerry Smith is from Texas, dammit.  He was appointed to the bench by Reagan, who apparently fertilized Smith ego and it has been growing ever since.

He wrote the majority opinion on Hopwood, which struck down affirmative action in admissions to UT law school.  He also wrote the opinion that said the EPA should be required to do a cost/benefit analysis when deciding what chemicals to ban.  In short, if the money business makes is greater than the lives of those harmed, don’t ban it.

He’s a creepy little man who pushes the edges of sanity.

Yesterday, he fell over the edge.  He ordered a young female Assistant US Attorney to write a “single spaced, no less than three page” report, due today, on President Obama’s right to criticize the judiciary.

So, it’s okay to criticize congress, and Lord knows it’s okay to criticize the President, but criticism of the judiciary will not be tolerated!

What he did is called “outside the record.” No, wait, I believe the correct legal term is “Dumber than bean dip.”

Hell, even Fox News thought he was out of line.

VAN SUSTEREN: I imagine the discussion tonight at the Justice Department – I would certainly be having this discussion – is to refuse to do it. Because it really is beyond what is necessary in the case. It has nothing to do with the case. And the lawyer answered the question in court. And it’s clearly just, you know, the judge is mad. And to refuse to do it, maybe you draw a contempt charge but then I would then take it up with the full court. I’m not so sure the Department of Justice has to comply with this.

What a silly little bully boy Ronald Regan appointed to the court.

I have no doubt that Eric Holder can take this guy to the woodshed in 2 pages or less.  I also have no doubt that Judge Smith is gonna learn real quick that holding the Attorney General of the United Damn States of America in contempt of court for something that has nothing to do with the case at hand is going to fly like a lead balloon.

Why do they always have to be from Texas?  Why?
