Kirby Delauter, He Who Also Cannot Be Named

Kirby Delauter got himself elected to the council of Frederick County, Maryland.  He apparently ran for this office of his own free will.

A local reporter by the name of Bethany Rodgers wrote a story for the newspaper and quoted Councilman Delauter.  She called the councilman for a comment prior to publishing her story but he refused to return her call.

Screen Shot 2015-01-06 at 11.22.25 AMShe wrote her story and the duly elected councilman did not take kindly to that.  He took it to Facebook.  You know, where he has “friends.”

In a Facebook post, Delauter slammed reporter Bethany Rodgers of the Fredericks News-Post “for an unauthorized use of my name and my reference” in an article over the weekend.

“So let me be clear,” he continued, apparently addressing Rodgers, “do not contact me and do not use my name or reference me in an unauthorized form in the future.”

He added that he’s aware that she has “a liberal agenda.”

Woooooooo.  A liberal agenda?  Why haven’t charges been filed, bygawd?

Ms. Rodgers informed Kirby Delauter that she does not need his permission to write about him.  She says that it’s responsibility to do so and she will continue to contact him to give him an opportunity to respond.

So Kirby Delauter responded:

So what he’s saying is that Fox News cannot mention President Obama’s name without President Obama’s permission?  Cool.

Kirby Delauter has a small problem with the First Amendment.  It, too, apparently has a liberal agenda.

So, in honor of Bethany Rodgers, please let me say ….

  2. I bet he claims to “love America.” He just hates what it stands for, like freedom of the press, and probably most of the people in it.

    How does someone get to be that old and still be that ignorant about where his “rights” start? He sounds like a nasty child.

    Come to think of it, he sounds like Putin and Kim.

    So she’s not supposed to write about him without permission AND she’s not supposed to contact him to try to get permission.

    Obviously he does not want to be mentioned in the local paper at all. That suits me fine, including anything he says in council meetings and any more campaigns he may run in.

    The thought with the lack of a right wing nut-case, for Governor, … they were ….kinda progressive.

    They, then found out….. the two (2) of them are the only Democrats they know.

    It’s a mystery.

    Kirby Deluded is a public figure-he is fair game for anyone to use his likeness or anything about him. That is settled law,I do believe.

  8. My daddy always counseled that one should not pick fights with people that bought ink by the gallon and paper by the ton. I know the world has changed but few of us can wordsmith at the rate that even the local newspaper stringer can wordsmith, whether in print or Facebook or Twitter.

    The savory scented marsupial is correct. Kirby is a public figure and can therefore be mentioned and/or have any and all of his public actions mentioned, analyzed, critiqued, criticized, or ridiculed. In fact, some of his private actions, if they happen to occur in a public place, are open to the same treatment.

  10. The fact that a local newspaper can write about Councilman Delauter is probably the first revelation of many in store for him, as he discovers how politics, his local council, and the great big world, work.

  11. Miemaw, our rep is Steny Hoyer too. PG County is about 4 or 5 to 1 Democrats, but Hoyer’s redrawn district includes most of southern Maryland, which may have GOP bastions.

    Greenbelt MD is known for being liberal. I’d like to have a Prius-per-capita smackdown with The People’s Republic of Takoma Park nearby, but I can’t figure out how to get the numbers.

  12. I bet he did not like what the article had to say about him; namely, the truth or too damn close to it. He just outed his own self as an overgrown over-testosteronized galoot of little brain. And he really didn’t need anyone helping him. I bet he does not last out his term on the council. Will probably resign claiming a huge conspiracy against him. And, Kirby, I gave my molecule sized violin away a long time ago. Go sing your own self to sleep.

    Apparently Mr. Delauter has no grasp of the First Amendment, among other things. This has to rank up there with Virginia Senator William Scott, who, after being named in a magazine feature as one of the dumbest members of Congress back in the late 1970s, called a press conference to deny it.

    In any case, Power Line, following Eugene Volokh and others, is delighted to join reporter Bethany Rodgers in using Mr. Delauter’s name without his permission! In fact, we’ll use his picture without his permission, too, and we’re going to name our newest award for the most clueless public official of the week after Mr. Delauter. And so, Power Line’s first ever Kirby Delauter Award for Cluelessness in Public Office goes to . . . Kirby Delauter.

    The ice and snow is an appropriate place to bury Cheney, considering he’s probably headed for the 9th circle of hell anyway. A plus is that some of us can write his name in the snow without using their hands!

    One wonders whether Kirby Delauter learned constitutional law from one of those Tea Party seminars. However, it sounds more like one of the wackobird types who trademark their name. and then try to sue anyone who uses it (typically in court pleadings) for infringement.

    Last I heard, it wasn’t working… Meanwhile, NY Times v Sullivan is still good law.
