The ABC news commentator said it would be impossible for Obama to get his nominee through the Senate. He may be right. That just underscores the importance of the November election.
1My first comment was “Sigh of relief”.

And, a blessing to Justice Scalia, that his death may be remembered as a turning point for democracy. Every man wants a legacy and may he have his. May he have his finest hour in November, when voters turn out to maintain our Constitutional history and protect President Obama’s duly given right and duty as our President to appoint a Supreme Court justice.
RIP, Tony. A good day of hunting followed by dying in bed is an end many can appreciate.

Deb, are you saying that if President Obama were to nominate HRC as a Justice that the snacilbupeR would confirm? Interesting thought. I hope you are correct, if I’m understanding you correctly.
19can’t celebrate his death – too much pain and loss for those who were close to him to ever go down that road. But I will be glad for the potential change in direction for the Court.
20PKM: You, sir, are correct. For whatever I may personally feel about the man, he was a Supreme Court Justice and deserves the respect due that office. May he rest in peace. My condolences to his family and all who feel sorrow for his passing.

PKM, Think about it, the Republicans are terrified of HRC. It isn’t just that they despise all things Clinton and all things Democratic it is that they know deep in their heart that they can’t beat her. They fear 8 more years of a Democrat in the WH, with all the ramifications therein. So, the opportunity to remove her from that milieu would be the only thing that would prevent Mitch McConnel from making a “last stand”.
So, we have a deadlocked Supreme Court with Kennedy as the only potential tie breaker. Selecting which appeals court to utilize just became crucial since when the court deadlocks the lower court’s decision stands.

Senate Majority Leader Mitch McConnell said the Senate should not confirm a replacement for Supreme Court Justice Antonin Scalia until after the 2016 election.
“The American people should have a voice in the selection of their next Supreme Court Justice. Therefore, this vacancy should not be filled until we have a new President,” the GOP leader said in a statement.
The statement from the Kentucky senator came a mere hour after the news of the conservative justice’s death was reported by major news outlets, belying his usual cautious nature and daring a bruising political fight with President Barack Obama alongside two leading GOP presidential contenders from the Senate, Marco Rubio and Ted Cruz
Senate Minority Leader Harry Reid (D-Nev.) immediately called for a replacement.
“Failing to fill this vacancy would be a shameful abdication of one of the Senate’s most essential Constitutional responsibilities,” Reid said in a statement.

3010 months left in term / 8 months till an alternate commander in chief is selected. The office requires immediate action & replacement for proper functioning of a full years of court functioning.
31JJ, you are nicer than I, because I have been just giddy since I heard the news. I echo Rufus’ wondering if Thomas — who never had an original thought or question and only followed Scalia’s lead — will follow suit.
I’m not normally one to relish in another’s death, and sadness and all that to his family who I am willing to believe might possibly be saddened by his death, but he was a horrid excuse for a human.
I am a gay man. And Scalia spent his entire judicial career trying to kill me. Literally. He thought gay people should be put to death. So pardon me if I find joy in the death of man that worked so hard to kill me. Yes, I am that petty. Hate me. I’m still giddy.
And please, just for perspective, let us remember that this is the man that complained after Lawrence v. Texas, which ruled that states couldn’t make homosexual sex illegal, that the ruling meant that states couldn’t make masturbation illegal, which was against the laws of his god. He thought that people who masturbated should be in jail.
I’m not really sure how you make masturbation illegal, but I don’t think we have enough jail cells to hold every horny teenage girl and boy (or the rest of us older folk) for exploring their sexuality. With apologies to the Catholic Church, of which Scalia was a devout member, because I know that the Catholic Church thinks that exploring teenage sexuality is something best left to Catholic Priests.
32Deb, thank you for the clarification and confirmation that I “read” you correctly. You made great points, my concern was that I would ‘put words in your mouth’ that you did not intend. HRC would be a great choice for the reasons you gave.
There are a number of excellent choices from whom President Obama can select. For the sake of our country and the future of the Earth, I’d recommend Michelle T. Friedland who was appointed to the 9th circuit by President Obama. Her progressive record and resume is impeccable.
33I’m not as giddy as Mark J but my first reaction was: Yes! Finally. His death couldn’t come soon enough.
(Although I’m sure Justice RBG would disagree with me since they were good friends.)
34Mark J, you are man of many dimensions; petty is NOT one of them. We are not celebrating a death, as much as we are celebrating the opportunity to restore sanity to our country.
While there should never be a religious litmus test for US Supreme Court justices, we the people should demand that anyone nominated understand and support the the 14th Amendment to the US Constitution. Liberty, justice and equality for all is what makes us a better nation.
35I hope that after an appropriate period of mourning for the passing of Justice Scalia — oh, that period has already passed — Pres. Obama will appoint a very liberal justice to replace him. The POGs have already stated that they will not vote on a replacement until after the election. But a solid liberal nominee will hopefully make clear to the voters what is at stake here.
36The Senate stands in recess this week for President’s Day. Justice Potter Stewart was the last recess appointment, under Eisenhower.
Anyone appointed during recess serves until the inception of the next Senate, which in this case meets next January. Then it can indeed be left to the next President, and the election serve as a plebiscite on this issue.
In the meantime, the Constitution is still the Constitution. Even the late Fat Tony would agree that the political calendar should not dictate to Presidential prerogative explicitly spelled out in all its originalist glory.

40With respect and condolences to his family, I did have a few giddy moments, because many has been the time I wished that man would walk in front of a Metrobus. (Apologies to the driver.) The country is better off without him on the seat of any court, especially the highest. He was one nasty, small-minded SOB.

I actually suspect he, his admin, might actually have some actionable contingency plans at the ready for this.
Obama has recently shown a bit of a “don’t give a sh!t about them stinkin’ R’s’ attitude” anyway, so he might just have the stones to jerk their chains.

45daChipster and Mark J, at this point in his Presidency, I doubt President Obama lacks resolve. He could come out swinging his Bucket list during the Congressional recess. But that would mean a temporary solution, interim appointment.
Obi Wan Keno-bee plays great 3 dimensional chess to the snacilbupeR tic-tac-toe. He can play this for a month and scare the crap out of them with potential nominations and within that same time frame appoint a recess choice. One month would be a milestone with this Congress not taking a recess.

As for Congress not taking a recess until President Obama leaves office? The varmints have elections at home. I’d love it if they all sat in their DC sandbox to stop the inevitable. Seriously, think about this. Does Mitch McConnell command the loyalty to keep the vacation boys & girls at their desks?
Mitch may or may not be able to keep his herd in town until Tuesday. But even if he does this one time; from now until 1/2017 with out a recess? Doubtful.
