You remember the movie, Network from 1976, yes?  If you don’t, go find it and watch it.  It’s about a major network anchor, Howard Beale (played by Peter Finch), who suddenly experiences enlightenment (or just goes stark raving mad) about the negligence of network television feeding bullshit to its audiences in a continuous stream.  Here’s one of the best rants from Howard:

Well, it’s happened again, for real this time, on MSNBC this morning.  Joe Scarborough went all Howard Beale on Mark Zuckerberg, pointing out his gross negligence in allowing bullshit to proliferate on Facebook that is now endangering lives and democracies all over the world.  This is mass media platinum, folks, not to be missed, though you do have to turn it down a bit when Joe loses control about halfway through the rant.  It would have been better if he collapsed on stage in a Bealeian finale.  Got to watch this:

Many of the stormtroopers that cleared Lafayette park the other evening to make a path for Trump to do his photo op in front of St. John’s Church were wearing tactical gear, but no badges, ID plates or insignia.  The press immediately noticed and began investigating.  The Washington Post got to the bottom of it this week – they’re from the federal Bureau of Prisons, called up personally by Bill Barr.  The BOP confirmed this shocking news and lied that they weren’t wearing BOP insignia or identification because they were being used “in a broader mission.”  NO, they wore no insignia to make it harder to figure out who to hold accountable for police violence.

Adding to his mountain of lies, Bill Barr actually denied ordering the BOP officers and others to clear Lafayette Park to give Trump a clear lane to carry out his stunt for the photo op. He said that park police were already clearing the park when he arrived. That assertion doesn’t pass the straight faced test, and that wasn’t the question.  The question is, did he give the order to clear the park so Trump could safely strut over to the church?  Of course he did, and while they were at it, cordoned off the park with heavy security fencing to permanently distance the White House from Americans Trump is hiding from.  And he did all that with his employees from his prisons in unmarked uniforms to conceal their identities.  This is the exact same tactic that Putin used when he deployed “little green men” into Ukraine in 2014 in his attempt to take over that country and Crimea.  The Russian government later admitted that those soldiers were indeed Russian military.

Welcome to the new normal of Trump’s America.

In yet another step toward Trumpist fascism, Trump has announced he’s signing an executive order to curb Twitter’s (and other social media platforms) ability to moderate content posted there.  Trump has regularly violated community standards on Twitter, spouting lies, conspiracy theories, personal attacks, and even accusations of murder.  Twitter, and Facebook for that matter, regularly police their platforms for fake news, bots, trolls, and threats.  Frankly, the job they do is inconsistent and generally piss-poor, allowing shocking content to stay posted.   The cancer within social media is the persistent presence of bots and troll which sow discontent, conflict, and dis-information to billions of users.

Up until this weekend, Twitter has allowed Trump to run rampant with no moderation, spreading bile sometimes hundreds of times a day.  The tipping point was his posting of lies and conspiracy theories this weekend about voting by mail.  Trump knows that the more people who vote, the less his chance of being reelected.  Let’s be clear about his intent.  He’s not concerned about non-existent voter fraud. He’s concerned about Americans voting. Period.  If there were free and fair elections with easy access to a ballot Trump will get walloped by double digits.  He and this toads know that, so he’s waging an all out war against voting by mail, even illegally threatening states by withholding appropriated funds from them (just like he did when he has attempting to extort Ukraine to get at Joe Biden).

My belief is this executive order will be just more Trump double speak to rile up his base and give him and Press Room Barbie more bile they can spread on national television and Twitter.  Trump is an ignorant, boorish, self-centered blowhard and everyone knows it, including actual lawyers.  Those lawyers know that the President of the United States attempting to stifle private parties that displease him is the textbook example of government violation of free speech rights.

Let’s review.  The First Amendment says,

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

The highlight is mine.  The First Amendment is designed to prevent the Congress from passing laws that abridge freedom of expression,  but case law over the centuries has established a general foundation that prevents the government from controlling what individuals can say or do.  Twitter and other social media platforms are private and establish terms of service and community standards of conduct.  Trump isn’t forced to use Twitter, he CHOSE it rather than what previous presidents have done by communicating to the People through press briefings and official statements.  He has cynically used Twitter specifically to spout bullshit that the press would (and does) immediately call him on.  He hates that, continuously trying to circumvent any fact checking by spewing his bile directly through the platform.

If Twitter is guilty of anything, it’s allowing this to go on far too long.  Any other individual spreading the kinds of personal attacks, libel, and outright falsehoods would have been banned long ago.  If Twitter would just cut him off, he would be forced to go back to conventional means of communication.  They opened this can of worms to drive more traffic to the platform and have looked the other way for years, so this crisis is as much their fault as Trump’s.

Trump’s executive order won’t really change anything except intimidate Twitter from any further attempts at moderation of his stream of daily manure that he spews.  I predict that, like his other jaw dropping conduct, will work and Twitter will back down, even though they should ban him today.

First, let me say that CNBC is generally more informative with the sound turned off.  I’ve actually stopped watching it during market days because the schedule is filled with talking heads (usually option and/or futures traders spewing bullshit trading strategies that nobody outside of specialists make any money doing.  The end of each day is polluted by Jim Kramer, who’s antics never produce any factual or useful information.  Yesterday morning, though, Andrew Ross Sorkin and Joe Kernen host the morning turned the sound way up, finally clashing after months of pandemic coverage where Sorkin raised genuine, thoughtful concerns and Kernen spouted pablum and was one of Trump’s biggest cheerleaders, covering up his massive failure in leadership or thinking of anyone but himself.  He made the mistake of lecturing Sorkin and spouting Trumpist talking points when Sorkin decided he’d had enough.  I’ve now watched it three times – it’s most entertaining.

Today, in a leaked audio of a call with Republican representatives, Greg Abbott admitted that opening up the economy will increase the community spread of COVID-19.  At the same time, he offered up his strawman argument that, since we’ll never get to zero spread, we should open up anyway.  Of course, NO ONE has EVER set the standard of zero spread.  The standard is 14 consecutive days of diminishing new cases, which we are most certainly not experiencing.

This is the same argument that Abbott and other Republicans have used to not do immigration reform.  They keep saying that reform can only happen when undocumented immigration is brought to zero.  They KNOW it will never be at zero, so by default immigration reform will never happen.

Greg Abbott is a small government, local control, free trader.  Until he’s not.  Abbott is the worst kind of politician, one who doesn’t really believe in anything but his own power, who shifts his ideology to fit the situation that always advantages himself and his largest donors.  Texas has always been very independent where local control has been sacrosanct, and the governor’s office was designed to be a weak position.  No more.  It started under Rick Perry, but Abbott put consolidation of power on steroids aided by a state house full of ideologues who are either stupid, corrupt, or likely both.

Abbott has seized power away from municipalities and counties on everything from oil and gas development to environmental regulation to even trimming trees.  In good times the consolidation of broad local authority to a central point is bad policy.  The US Constitution recognized the role of the states in limiting the power of the federal government.  Abbott and Perry quoted that loudly and often with Barack Obama occupied the White House.  No more.  Now, Abbott cherry picks what he wants to control, like tree removals for some weird personal reason, and has done so again by abruptly ordering the reopening of thousands of businesses in Texas over the orders of municipal and county authorities all over the state.

What Abbott is doing is stupid; it’s not only stupid, he’s also doing it for precisely the wrong reasons.  He’s not rushing to reopen the state’s businesses because he believes it’s the right thing to do, he’s doing it to kick hundreds of thousands of workers off of state unemployment rolls.  The Texas Workforce Commission has already announced that if a business reopens and employees do not work ALL of the hours required by that business, the employees lose their unemployment benefits. Cisco Gamez, a Texas Workforce Commission spokesman even said that if an employee doesn’t feel safe working, they must refer their concerns to the US Occupational Safety and Health Administration, governed by the US Labor Department currently run by…wait for it…Eugene Scalia.  Yes, that Scalia, the son of Antonin Scalia.  The younger Scalia who’s made his career and is well known for undoing worker and safety regulations, was appointed by Trump to head the agency tasked with protecting workers’ rights (Yes, it’s a drinking game.)  Since Gamez’s statement, the Texas Workforce Commission “clarified” the policy that the state “may” allow some benefits to survive if a worker doesn’t feel safe to go to work.

The dangerous feature of Abbott’s idiotic orders is that he’s going to damage the programs that adults, like Lina Hidalgo and Sylvester Turner, have been implementing round the clock to protect those in Harris County.  The result is reduced cases here, but according to latest data from Johns Hopkins COVID-19 tracking program, Harris County new cases are still growing at an average weekly rate of 13%, which is low compared to other counties like Tarrant County, location of Fort Worth.  That city is governed by Trump supporter Betsy Price, who has already ordered that churches can begin holding services and bars and restaurants can open.  Their case growth rate? 51% this week.  That’s right, THREE times that of Harris County.  And those are just the cases we know about.

Abbott, like Trump, is literally getting people killed.  And he’s covering it up.  To keep the numbers low, I’m convinced Abbott is dragging his feet on broad distribution of testing.  Like Trump, Abbott keeps promising millions of tests that never materialize.  Texas has tested just over 200,000 people or less than 1% of the population.  Every medical expert advises not to reopen businesses and public buildings until testing and contact tracing is massive.  Abbot clearly doesn’t want that because then it would be hard to justify what he’s doing right now.

Abbott’s plan is dangerous.  Overruling local officials who are actually listening to medical experts is nothing short of gross negligence.
