Okay, so I saw this headline —-

 

 

The guy got eight months. Not bad for felony terrorism, if ya ask me.

Okay, so you break into the Capitol threatening to overthrow the United States government by force and you’re carrying a Trump flag with a sharp point, not unlike the flag used to stab a police officer, but some lawyer can bully you? Some damn fine soldier for freedom you are, sir.

 

 

That’s him, Paul Hodgkins, right there bullying members of congress.  Yeah, most of them are older than dirt and don’t carry around stick poles.

And they call us snowflakes?

    Based on the slight to light sentences divvied up by these terrorists, every drug offender should be released from prison; immediately. Those who are perceived as PsOC should be given restitution based on months/years served.

    All of the insurrectionists should carry that felony conviction for the rest of their lives. BTW, GOPers have made it so that felons who have served their time still can’t vote. Who they haven’t killed with COVID, may be restricted from voting!

    Agree with AK Lynne. If he had a plea deal he wants to retract, let him, try him and give him the max sentence for terrorism. It’s not like he’s that smart. Might send a message to the other dumb shits that have been arrested and there are 100’s.

    Re Steve from Beaverton’s suggestion: do any of the legal minds here know if it’s possible to retract a plea bargain once you’ve pled guilty and are headed for or actually in the hoosegow? Short of getting a presidential pardon, that is, or appealing the case.

    As for the sentence, I’m curious where the guy is headed. For non-felony cases generally there’s a limit to two years, and it is served in jail, not prison. For those who haven’t dealt with this, jail is usually vastly more onerous than prison. There’s no need for providing books, or educational training, or anything but sitting in a cell. Plus, if they are serving in a D.C. jail, you can bet that both inmates and guards are gonna be real unfriendly to the insurrectionists.

    Long ago in Urbana, IL there was a creep who captured house cats, and tortured them to death over a period of days. He used pliers to break their legs, a blow torch, etc. Unfortunately animal cruelty was only a misdemeanor. But the judge sentenced him to 2 years minus a day, the maximum possible. And she required that he not be allowed any work-release, like picking up trash on the highways. I’m convinced he was probably in D.C. on Jan 6.

  7. SurlyProf @5: Yes and no, but mostly no. Once you have appeared before a judge, who has gone through with you all the Constitutional rights you give up by pleading Guilty, and what your expectations can be as to sentencing, and then formally takes and accepts your plea and imposes sentence, you can’t pull a “wait I changed my mind” and take it back. You have to be able to show either misconduct on the part of the Government (such as withholding favorable evidence that you just found out about) or ineffective assistance by your counsel, which is where this guy is trying to go. And it can’t just be “my lawyer should have gotten me a better deal”, it has to be “my lawyer misinformed me about substantial matters of law in the case” or “my lawyer was secretly trying to get hired as a prosecutor and curry favor with the Government”, something like that. So you can see what he’s trying to argue but hard to imagine he’ll get anywhere with it.

    Then again, a lot of stuff has gone on with these creeps that would’ve been hard to imagine not too long ago….

    In the small world category, I actually shared an office for a year with one of the idiots that got arrested. He was one of three or four Houston area folks arrested. We always knew something was off and that was particularly true when we heard his politics. Unfortunately, I haven’t been able to keep up with his case.

  9. Wasn’t there one a few years ago where someone took back their guilty plea because the judge gave him 5 years? He got a jury trial and the jury gave him 25 years.
