Your Daily Rick

Holy cow!  Did you know that one of the grand jurors on the Rick Perry indictment is a Democrat and attended the State Democratic Convention?  Well, there ya go – proof this is political.

One of the 12 grand jurors is a certified Democrat and everybody knows that Democrats cannot be fair.

Jonathan Turley almost has a heart attack about it because while at the state convention the grand juror had her picture taken with State Senator Kirk Watson, who was called to testify before the grand jury.  Turley also feels it is necessary to print her name and her Facebook page.  That’ll show those damn Democrats to keep their noses out of government.

Turley, who is decidedly blowing the top off the idiot scale, speculated that the grand juror and Watson even discussed the case while at the state convention.

She was also photographed with Democratic state Sen. Kirk Watson, a witness. It is not known if she discussed the matter with him.

Turley, you need slapping.  You really do.  In Texas, you can go to prison for discussing grand jury information.  You are accusing a woman you do not know and a respected state senator of committing a serious crime.

TurleySomebody forgot to tell Turley that it takes nine votes to indict, not one.  Turley, who is a big city boy, doesn’t understand that in small Texas towns – like the one I live in – it’s reasonable and likely for you to personally know every witness before a grand jury you’re serving on.  Been there, done that myownself.

Plus, Turley does not know if this woman did, in fact, recuse herself.  That information is also secret.

You know, it peeves the hell out of me that people like Turley hold Texas grand jurors to a higher standard of impartiality than they do Supreme Court justices.  Scalia and Thomas don’t recuse themselves on highly political matters. Ever. Trump that, Turley.

Turley needs to read Wayne Slater, a Texan, this morning.  And so should you.

Shame on Turley. And nobody is s’posed to tell names or private lives of Grand Jury members. Nobody.

    Question…

How does Perry’s defense square with the ADA?

    http://www.nolo.com/legal-encyclopedia/hr-health-and-safety-faq-46880-6.html

Is alcoholism a disability under the Americans with Disabilities Act?

“Yes, but that doesn’’t mean an employer has to put up with an employee’s drinking. The disease of alcoholism meets the definition of a disability, which means that an employer may not make job decisions based on the fact that an employee is an alcoholic, attends AA meetings, or takes medication to curb the urge to drink. However, an employer may prohibit drinking at work and may generally hold all employees to the same standards of performance and conduct. An employee who can’’t meet those standards because of drinking may be disciplined and ultimately terminated, even if the employee is an alcoholic.

So, if Rosemary Lehmberg served her time & followed all requirements post arrest, she cannot be fired under the ADA.

    Am I understanding this right?

Marge – the names of the members of the grand jury are public information. However, printing their names in a national forum is just considered crass. She was doing her civic duty and her motivations, behavior, and actions are being called into question. This is not encouraging to other people who might consider serving on a grand jury. Additionally, his language accused her of committing a crime. She ought to sue him.

Rains – well, not really. He asked her to step down voluntarily, not fire her. There was a three day civil hearing to remove her from office, which is the proper way to remove an elected official. She won.

  5. Turley . . .

    Shouldn’t that be a “k” instead of an “l”?

  6. I always admired Jonathan Turley’s knowledge of constitutional law when he was a frequent guest on Countdown. I don’t know why he’d step into this mess.

    Thanks, Susan.

LynnN, works for me! Alternatively, you could insert a “d” between the “r” and the “l.” Either way the poor guy seems hellbent on tarnishing his own credentials as a scholar of any sort.

  9. What are the chances? You put 12 people in a room and one might be a Democrat? In an election, if you average it out, about 1/2 the voters are Democrats and 1/2 are Republicans. I would find it more surprising if no one on the Grand Jury was a Democrat.

In Turley World, he probably thinks the only fair Grand Jury would consist of 12 Republicans. Or better yet, 12 Republican elected officials.

    9
  10. What happened to those republicans in Texas gov’t who were arrested on DUI charges, did they get fired?

  11. The thing that just keeps going through my head….. in regards to Governor Goodhair…..

is Nixon’s famous “I AM NOT A CROOK” line.

  13. Since when is it against the law for a Democrat to serve on a grand jury? have a picture taken with a Democratic State Senator? This Turd of a Turkey is pre-judging, and that bias disqualifies him from making judgments on just about everything. Is it Thanksgiving yet?

    13
  14. Did she disclose her ties to Watson? We don’t know. Did the judge have a hearing on her recusal with Perry’s lawyers participating? Probably not, but we don’t know. Did Perry’s lawyers agree that there was no legal reason to recuse her? Probably not, but we don’t know? Did she vote to ute bill? We don’t know? Did she vote to no bill? We don’t know. Was her vote necessary to get to nine? We don’t know.

I’ll tell you one thing I do know. Mike McCrum is not the kind of guy who normally lets his mouth overload his ass. McCrum is as serious as a heart attack. Do not underestimate this man, as his abilities and ethical conduct are very high.

    14
  15. I have no idea why spellcheck replaced true bill with ute bill. Sorry.

    15
  16. Turley sure seems to know a lot about what the two individuals discussed when they met, even though he knows nothing. Amazing! I sure wish I had this ability. Turley began to turn me off when he would appear on MSNBC to undermine Pres. Obama with his claim that the president was breaking the law for doing the same thing other presidents have done in the past.

Where was he when other presidents were doing the same thing? Why didn’t he speak up about it? It got to the point where when Turley’s face appeared on MSNBC, I changed the channel.

    16
  17. Turley turley is so squirrely…Nope, he’s pretty much a douche, to quote Parks and Rec– I don’t know what has happened to him, but it seems in the coincidental Obama era, he has had a right wing transplant. What an idiot. The only thing he should weigh in on is a scale.

    17
  18. Has Turley gotten nutty lately or was he always like this? I used to watch him all the time on (the late, lamented) Countdown, and he seemed very knowledgeable and not particularly partisan. Lately he seems to have gone over to the Dark Side.

    18
  19. Turley got his start as a TV star during the Clinton impeachment where he was a “legal” expert and I thought he was a bit biased and nutty even then.
