The Supremes sent the Texas redistricting case back to the three judge panel in San Antonio. They said the lower court had to find a “reasonable probability” of Section 5 violation of the Voting Rights Act before they could completely redraw the maps.
Good Lord, have they looked at what happened to Hispanics in redistricting?
Justice Clarence Thomas added his own opinion that Section 5 of the Voting Rights Act is unconstitutional.
Section 5 says that the Department of Justice needs to pre-clear new boundaries to keep the southern states from wildly discriminating against minorities. Yep, that’s clearly unconstitutional.
