18 U.S. Code § 2384 – Seditious conspiracy

January 07, 2021 By: El Jefe Category: 2020 Election, Sedition

Every single person who set foot on the Capitol grounds yesterday carrying out Trump’s orders is guilty of the law noted above.  This crime is felony, punishable by incarceration for up to 20 years.  The law reads:

“If two or more persons in any State or Territory, or in any place subject to the jurisdiction of the United States, conspire to overthrow, put down, or to destroy by force the Government of the United States, or to levy war against them, or to oppose by force the authority thereof, or by force to prevent, hinder, or delay the execution of any law of the United States, or by force to seize, take, or possess any property of the United States contrary to the authority thereof, they shall each be fined under this title or imprisoned not more than twenty years, or both.”

This idiot is Jake Angeli, a well known Qanon conspiracy theorist who regularly shoots off his mouth at demonstrations.  He led the way into the Capitol yesterday with other rioters, and took part in taking over the Senate Chamber and was photographed on the dias. Yes, that’s a spear he’s carrying with an American flag tied to it.  He took a leadership role in this riot and sacking of the Capitol Building, and then, like the vast majority of these rioters simply walked out a free man.  To my knowledge he is still walking free.  He dresses like this to admittedly “attract attention”.  Like many Trumpists and “sovereign citizens” he obviously believes he’s above the law and can act with impunity (up to now, at least, he seems to be correct in his suppositions since he hasn’t been arrested in the past for his conduct.  At minimum, he’s now in violation of the Seditious Conspiracy law, as well as likely a number of other state, local, and federal laws.

This guy’s face is everywhere, so my question is, why in the hell is this criminal still walking the streets?  He, and everyone who participated in this riot and destruction of the Capitol building are criminals.  These criminals must be rounded up, jailed, charged and tried, and I mean swiftly.  The only way you stop this kind of behavior is to begin to swiftly bring these people to justice.  Charge them with crimes; confiscate their weapons, make to do actual serious jail time.  Only when we start enforcing the rule of law can we put a stop to this kind of protest.  This is not a First Amendment issue; this is a criminal sedition issue.  When Trump’s goons set foot on the Capitol Hill grounds, the protest ceased being a demonstration and became a felony.  We need to treat it that way, and I mean now.

  1. “…why in the hell is this criminal still walking the streets?”

    Because he’s white.

Because he can use the affirmative defense of IOKIYAR!

He MUST NOT be arrested until after Trump lo longer has pardoning power.

  4. The government consists of a gang of men exactly like you and me. They have, taking one with another, no special talent for the business of government; they have only a talent for getting and holding office. Their principal device to that end is to search out groups who pant and pine for something they can’t get and to promise to give it to them. Nine times out of ten that promise is worth nothing. The tenth time is made good by looting A to satisfy B. In other words, government is a broker in pillage, and every election is sort of an advance auction sale of stolen goods.

  5. Good article on a path to stopping Drumpf which I think is necessary before his destruction continues. His powers to fire, pardon, executive order, etc. must stop now. Once he is unable to help them, the protesters should be arrested. It shouldn’t be hard to identify them.

The 25th Amendment stops him immediately and opens the door for impeachment #2. A successful impeachment stops him from ever seeking political office in our country.

His message this morning about NOW respecting the transition of power (if it, in fact, came from him) sounds like backpedaling to avoid responsibility for his actions yesterday, as always seems to work for him (“he was just kidding” being the famous response).

Certain levels of authority in our country are really pathetic if no action is taken immediately to remove this president.

  6. Imagine, if you will, a similar scenario except all the players are minorities. Murder and mayhem would be the official response.
White privilege has reached a new low.

  7. @Richard – It takes no imagination whatsoever. See the picture at https://www.cnn.com/2021/01/07/us/police-response-black-lives-matter-protest-us-capitol/index.html

Of course, that’s the National Guard acting on the orders of the Commander in Chief.

Many people (sorry for the Trump-like circumlocution) have been doxxing the insurrectionists, but are holding back the results. The on-line discussion focuses on whether or not posting names will make it easier for Trump to pardon all of the riot apes. Some (yeah, I know, yet another Trump-oid word) are claiming that people should wait two weeks to post results.

As I’ve stated here before, I know diddly about the law. The question is: can Trump issue a pardon for all the treason monkeys without giving names, or is an actual list required? I recall Carter pardoned all the draft dodgers from the Vietnam War, but don’t know the mechanics of that. Did each person have to apply and get their name added?

These thugs pushed their way into State Houses around the nation last year. They know that nothing is going to happen to them because they are acting at the behest of Trump who is above the law.

Unfortunately, I see this type of person all the time in my community. At every opportunity, they intimidate and harass their fellow citizens.

    They are Trump’s brown shirts.

  10. Imagine the police response if protestors broke down barriers at the White House, smashed windows, roamed the East Wing with spears, and ransacked papers and computers in the West Wing? Then for good measure sat behind the Resolute Desk for a selfie while dressed like a Viking?

  12. Lock them up!
In the meantime, did anybody notice if Congress certified Biden’s win???
Trumps malignant narcissism wins again, EVERYBODY’S talking about him.

He likes to see himself on the TV and doesn’t like to be upstaged, don’t cha know.

  13. lex #12: I noticed! I stayed up to watch (easier since I’m on the West Coast). I think it was around 1 am for me. Gohmert objected to Wisconsin but no Senator signed on, so he was told to sit down and shut up, in effect. Very satisfying.

  14. Hannah @13 Thanks good to know!

Again, and the reason Trump does everything, good or bad, is he addictivly needs to be in the spotlight.
